Server revenue increases for all except Oracle in Q3

Gartner on Monday said worldwide server shipments and revenue went up during the third quarter, while sales for Unix servers based on the RISC and Itanium architectures continued to slip.

The research firm said that worldwide server shipments totaled 2.2 million in the third quarter, growing by 14.2 percent compared to last year’s third quarter. Server revenue was $12.29 billion, up 15.3 percent year over year.

We say it can be attached to an iPhone as communication is done wirelessly, so you’ll probably be able to monitor your ticker’s rhythm without the Applephone pressed against your bosom. Ford MyKey adds radio censorship to further control teen driving habits

Daddy doesn’t have to take the T-Bird away, he can just take all the fun out of driving it. That is, if the T-Bird is actually a Taurus. Ford’s MyKey system has been engendering teen resentment since the release of the 2010 Focus, allowing parents to limit max speeds and cap radio volume, but parental control doesn’t stop there — the 2011 MyKey can selectively block radio stations. Starting next year, parents will have the option to block 16 Sirius radio channels from the car’s dial, among them Howard Stern, Playboy, and Hip-Hop Nation. Optional radio censorship isn’t the only new feature for MyKey, which allows owners to program a key to fit their specific level of paranoia — the new version allows parents to set top speeds between 65 and 80mph, instead of the previous fixed cap of 80mph. Other controls carrying over from the original system include a chime that sounds at 10mph intervals, starting at 45mph, and an advanced notice when fuel levels are low. The new features will come standard issue on the 2011 Ford Taurus and Ford Explorer, and will eventually reach across both the Ford and Lincoln brands.

Amazon enables Kindle e-book lending

This is great news for the mom of at least one Engadget editor (who has been despairing at her inability to share e-books with Aunt Kathy). That’s right: Amazon has enabled Kindle book loaning on select titles. Of course, there are caveats: books can be loaned only once, for a period of fourteen days. As you’d suspect, the loaned books can be read using the e-reader itself or the free Kindle app for any of your various devices (including iOS, BlackBerry, Android, PC, and Mac). While a book is being borrowed you can’t read it yourself, and the publisher has the final word on which titles are eligible for lending. Exciting, right? At least as exciting as the opportunity to finally discover what The Secret Life of Bees might be.

Clear iSpot discontinued already

Well, that certainly didn’t last very long, did it? Looks like Clear is already sending its unusual iSpot product to the great WiMAX network in the sky less than five months after its introduction. As a refresher, the iSpot’s claim to fame is that it was designed to work only with iPhones, iPod touches, and iPads — and in exchange for the crazy restriction, Clear would charge you less than $100 for the hotspot itself and just $25 a month for unlimited 4G access capped at 6Mbps down. Of course, it’s easy to understand why Clear would want to forget the iSpot ever existed: its MAC address filtering was easily defeated and plagued with reports that even approved devices were being denied access, suggesting that the concept probably wasn’t a solid one in the first place. For what it’s worth, Clear retail stores are still selling through remaining stock if you’re interested — and the company will maintain a supply of units for warranty replacements — but otherwise, you’re out of luck.

Fiabee releases companion apps to share, sync files between Chrome and Android

Fiabee is a relative newcomer to the cloud-to-mobile storage game, having only released its iOS app [iTunes link] back in June. The company has now begun focusing on Google’s platforms and has made beta versions of the Fiabee app available for Android devices and Google Chrome.

The Fiabee Chrome app is no bookmark — it’s an extension app (all its HTML, JavaScript, CSS, images, and fonts are stored on your system) that provides a much different experience from the Fiabee website. Install the app and create an account, and you’re given 1GB of cloud storage which you can use to share files from your desktop Chrome browser to your Android handset. Open your favorite file management app, find the file you want to upload, and then drag it on to the appropriate drop zone — the blue box saves it to your cloud storage, while the green box takes the additional step of notifying your Android device that a new transfer is available.

Honda, Acura customer data stolen in third-party breach

The last couple months of this year are starting to look like Breachfest 2010, and a new report in The Columbus Dispatch indicates that the latest victims are registered owners of Honda and Acura vehicles. As was the case with the McDonald’s incident, it wasn’t Honda or Acura specifically that was attacked — but rather a third-party company who handled a customer email database.

In addition to the usual information like names and email addresses, the data also contained customer VINs (vehicle identification numbers). Armed with a VIN, it could be possible for a thief to obtain duplicate keys — which is obviously very, very bad. It’s more likely, however, that the data will be used to carry out phishing attacks. Armed with knowledge of the customers’ vehicles, the phisher could pose as a Honda representative in an attempt to trick users into running a malicious attachment.

Honda has already reached out to all those affected — some 2.2 million people. The company has also added a new section to its FAQ, which you can read here.

Update: Ignore this. Kellex from Droid Life points out to us that "exclusive" pic actually has been around for months.

Look at this dummy phone (ie one that looks like the actual device but is for display purposes only — like what you see in Best Buy) of the HTC Thunderbolt, and you probably wouldn’t think twice. Same camera, flashes and kickstand. But there are a few subtle details that are different from the earlier leak we saw this week.

The "With Google" slogan on the kickstand has been replaced with "With HTC Sense," there’s an "8.0 MEGA PIXELS" stenciled near the camera lens, and the "4G LTE" stencil is gone. It’s our understanding that the earlier leak was early marketing renders from Verizon, so it wouldn’t surprise us in the least to see that things have changed. And "With HTC Sense," is more likely for a Sense device, isn’t it?

Why did Pluto lose its planet status? Because it never mattered enough

It’s kind of hard to accept, Pluto has always been our favorite underdog, but the truth is that the Solar System‘s ninth planet was never really significant enough to earn that designation. Such is the coldly logical reason given for its removal from the planetary annals by a man who had a lot to do with its demise. Caltech astronomer Mike Brown discovered Eris, what he’d hoped was the tenth planet, back in 2005, but its extreme distance from the Sun and diminutive (by planetary standards) dimensions disqualified it from consideration. Unfortunately, its discovery is what doomed Pluto to be downgraded to a “dwarf planet,” though Mike’s not shedding too many tears over it. In fact, he’s gone and written a book about the whole thing, the smug planet destroyer that he is. You don’t have to buy it to learn more, however, as the source link has an interview with Mike all ready and waiting.

Man, who needs to go to CES anymore? Intel’s frailly maintained secrecy around Sandy Bridge processor identities has been blown to smithereens today by Italian systems integrator Santech. The company lists a now familiar Core i7-2630QM (quad-core, 2GHz) alongside an i7-2720QM (2.2GHz), an i7-2820QM (2.3GHz), and an i7-2920XM (2.5GHz), confirming once and for all that Intel has completely lost its mind when it comes to naming chips. Other specs include up to 16GB of DDR3 RAM, up to 750GB of magnetic storage or 160GB of the solid state stuff, a pair of USB 3.0 ports, and a 15.6-inch display that can be either glossy or matte, with a resolution of either 1366 x 768 or 1920 x 1080, depending on your preference and budget. Deliveries are said to start on January 27th and prices range between €1,200 ($1,577) and €3,000 ($3,943).

I’ve got a serious text editor fetish, and as such, it extends across devices. I’ve been on the lookout for a simple text editor for Android for a while now. There’s complex software, with tagging support, SimpleNote sync and lots of other bells and whistles, and at the other end of the range there are really simple editors with no sync functionality at all.

And then I found Epistle. I’ve just started testing it, but so far I’m pretty excited about it. It’s as simple as can be, with just one extra: it supports Dropbox sync, and the sync appears to work well. You create a note on the device, and it instantly appears in a Dropbox folder called epistle right at the root of your Dropbox. Update the note on the desktop, and it’s updated on the device.

Epistle’s two main disadvantages at this point are that it doesn’t let you pick a Dropbox folder manually but just adds a folder to your Dropbox root, and that it doesn’t support right-to-left languages such as Hebrew and Arabic. Other than that, it’s a fairly strong contender in the “simple editor” category.

Hands-on: Pinboard is a great Delicious alternative

So, Yahoo! went ahead and announced it doesn’t like Delicious anymore. This is pretty much the dumbest move I’ve seen Yahoo! do in recent memory, and Delicious is going to fight for its survival outside of Yahoo!.

I really hope Delicious is going to make it, and I have every reason to believe it will. It’s an incredible service, and one of the cornerstones of the Internet. Still, since I rely so heavily on Delicious, as soon as word got out about Yahoo! trying to kill it, I started looking for alternatives.

One of the most-hyped alternatives is called Pinboard, a paid service with an interesting pricing model: you pay a one-time fee determined by the current number of users * $0.001. This means the more users sign on, the more expensive it becomes. When I signed on a couple of days ago, the price was around $7. Now it’s $8.65, and will probably keep rising.

Still, it’s not a lot of money to pay for a safe home for all of my bookmarks, away from a big company that may make questionable decisions about a service critical to so many users.

HTC HD2 gets a stable Android ROM that’s bootable from internal storage


No doubt about it the HTC HD2 is pretty darn beautiful device. With the exception of the OS that it came pre-loaded with. Developers have been hacking Android onto the device for quite some time now. Problem with that though is previously, users had to boot to Windows Mobile and then into Android, not ideal by any means.

Now with the release of a new ROM anyone wanting to load Android up on their HTC HD2 can do so by flashing right to the NAND memory and booting directly into Android bypassing Windows Mobile altogether. Granted, the process is still a little bit for the more advanced users out there but hey, if you got an HD2 kicking around that you want to make use of, give it a go. Stupid Windows Trick: just start typing to jump to a specific file in Explorer

Lots of the Windows tips and tricks I’ve picked up over the years are the result of facepalm moments. For example, I went years before finding out that you could right-click the Start Menu’s programs list to sort by name. These moments of ‘duh’ prompted me to share some of these Stupid Windows Tricks, and today I’ve got another one that probably took me way too long to figure out.
If you open Windows Explorer and want to jump to a file, and you already know its name, you can jump to it simply by typing. As soon as the window in my screenshot opened, I typed m-a-n — and by then, Explorer had highlighted my Mango image. You’ve got to type rapid-fire, though. If you’re too slow, Explorer will think you quit your original attempt and started a new one. If I paused too long after the m, for example, it would jump to a file beginning with a when I continued.

Is this going to boost your productivity? Probably not, but I actually find myself doing this on a semi-regular basis — though probably because I think it’s kinda cool.

Vee?s Law of Compunction

With new wine sales channels (like wine clubs) proliferating like mushrooms after a spring rain, I’m contemplating creating a new law of popular thought—like Murphy’s Law—except my law is about the forever altered line that once separated wine editorial from wine commerce.

I call it Vee’s Law of Compunction.  The name of the law itself is a misnomer, and maybe that’s the point – compunction indicates a distress of conscience, and I don’t think that exists, even if it should.

208 weeks ago or 48 months ago it would have been unfathomable and heretical for an organization that notably reviews wines to also sell wine.  Hidebound tradition dictated that those that review wine should not be a party to the commerce of wine.  This extended to magazine mastheads as well, yes.

Then, Gary Vee, owner of a wine store in New Jersey, started doing reviews.  Sure, he took some flak based on the suggested impropriety of reviewing what you’re selling (he was also greatly abetted by the notion of, “new territory, new rules”), and he artfully deflected that criticism with statements indicating that he reviews fairly and often dismisses wines that he sells.  Of course, his is an accurate statement even if a violation of the wine world’s unspoken rules of propriety and clearly a gray area when contrasted against his ethos of, “Trust YOUR palate.”

With that watershed moment, proverbially speaking, the horse left the barn, the ship sailed and the genie left the bottle …  A precedent had been set and the blurred lines of what wine content is and where it comes from organically disappeared along with these unspoken rules of fair, ethical play.

Since then, traditionally ethical media properties like the Wall Street Journal, Food & Wine magazine and other beacons of wine editorial have started their own wine clubs (along with a slew of others) and have filled the breach of branded (and implicitly recommended) wine club sales with consumer’s to near overabundance. 

To fully understand the implications of new areas to sell wine is to understand the notion of sales “channels.” 

When I interviewed for my first job out of school I needed the HR recruiter to explain to me what “channel” meant as she referred to the channel sales job for which I was interviewing. My business naiveté faux pas aside, I now well know that a “channel” is one specific sales focus area for an organization. 

Wineries have the three-tier distribution channel (and within that channel you have on and off-premise placement), the tasting room channel, the direct-to-consumer channel and, now, exceedingly, the gray market channel with intermediaries that are little more than short term pimps for a tarted up darling.

Despite the inherent nature of the gray market, all wineries (all businesses!) are looking for alternate sales channels.  Where can a winery sell its wine where, perhaps, they haven’t sold it in the past? 

This background brings us to the latest entrant in the “I recommend wine and, by the way, I can sell it to you to” school of New Thought—The Winery Club by Wine Enthusiast.

Lost in the din of the holidays, The Winery Club by Wine Enthusiast is likely going to miss the au courant naysayers in the online court of public opinion.  However, I can’t help but feel reticence, perhaps even my own compunction, about its launch despite being a bystander.

I should note, I like Wine Enthusiast magazine, I’m a long-time subscriber to the magazine, a confirmed recycler of the catalog, and I send emails to the publisher and I get replies. In addition, I am an admirer of their principal wine critic, Steve Heimoff; an affection that has grown over the last several years.  Yet, I’m not an apologist, either …

Neither a Huck Finn whitewash nor a Gary Vee traipse across boundary lines of traditional demarcation do not create validation for a business decision.  A mandate from the Gods of Capitalism doesn’t become so just because the rules of engagement have changed. 

In short, I’m sorely disappointed that Wine Enthusiast has chosen to create a wine club, indelibly erasing the lines for ethical behavior that separated those that opined on wine from those that sold wine.

Now, Wine Enthusiast Companies will rightfully and fully say the wine club is separate from the magazine; more aligned with the wine accessory catalog business than the magazine.  Yet, to me, it still feels like a shift in the force, to use a Star Wars reference – instead of the recognition of an area of profitable commerce, it smacks of the loss of the last vestige of integrity.

Destroyed in the process of what’s right has been a decision for right now.

Now, make no mistake the majority of the soon-to-be members of their “The Winery Club” have no idea that a wine magazine selling wine crosses the border into the dubious, nor do they care.  Yet, that’s exactly the point.  Perhaps, Vee’s Law of Compunction isn’t required because that indicates the opportunity for regret, but simple common sense is required …

For me, the wine world is a respite from the real world, an oasis of integrity and the right side of right and wrong.

Wine Enthusiast launching a wine club feels like the end of innocence, and the realization that my Mom was, indeed, right—just because you can do something doesn’t mean you should.  And, failing that, compunction is the feeling you get when you violate your own standards.

So the Chrome Web Store is upon us, and I decided to cover my first Web Store application for Download Squad. Rather than aiming for something high-profile like the Tiger Woods PGA Tour Online app, I decided to go with Metrodome!

Yes, it’s just a humble metronome, but it’s graceful. It comes with three different sound options (a “tick”, a “beep” and a “tock”), all quite pleasant-sounding. But what I like best about it is that it shows a huge dot right in the middle of the window, that goes on and off to the beat. This makes it possible to play by eyesight rather than by listening to the metronome, so you can jam with your headphones connected to your amp and just watch the metronome on-screen.

You can set the BPM, of course, but only by clicking the up/down arrows. This means you’re in for a lot of clicking if you want something drastically different than the default (120bpm). This is actually the only extra feature I wish this metronome had. Other than that, it’s a beaut!

Freemake Video Converter adds Blu-Ray support, Web video downloading

Freemake’s free Video Converter was already a very solid app, handling more than 200 import formats and able to output converted videos for playback on a wide array of devices. In the recently-released version 2.0, however, one major piece of missing functionality has been added.

Freemake 2 now supports Blu-Ray burning, allowing you to output dozens of hours of downloaded video to a single disc. If you don’t have a Blu-Ray burner, no worries — Freemake claims their media conversion kung-fu lets them cram 20 hours onto a single-layer DVD.

The upgrade doesn’t stop there, however. Freemake 2 also adds the ability to download and convert videos directly from popular sharing sites like Facebook, YouTube, and Metacafe. Beyond sharing sites, Freemake can also grab video from Hulu, South Park Studios, The Daily Show, Megavideo, and several others — including a good number of sites in the red light district. There’s also a more full-featured preset editor, giving you advanced control over your default conversion settings.

The .Net 4.0 framework is required, but Freemake will install it for you if it’s not already on your system.

France considering tablet tax, Windows bizarrely excluded

French tablet manufacturer Archos is none too pleased with the French government’s move towards applying a Private Copy tax to tablets running Android and iOS. In France, the controversial "Copie Privée" levy is applied to sales of blank writeable media, under the assumption that it’ll be used to infringe copyright. Some 75 percent of the funds brought in are then distributed to starving French writers, producers and performers.

Now the French government is considering imposing the levy on tablet computers with more than 40GB of on-board storage, which could lead to tablet prices increasing by €12.

This isn’t as strange as it might sound. Personal media players and multimedia-capable phones are already subject to the levy, so this could be seen as eliminating a loophole for similar but currently untaxed devices. What is odd, though, is that Windows 7 tablets won’t be taxed. This is all down to the very specific language used to determine what is and isn’t a mobile device. Android tablets apparently fit the description of being "provided with an operating system for mobile devices", while Windows is considered a desktop OS even when it’s running on a tablet of the same size.

Archos is understandably peeved, and claims that this unfairly targets French tablet manufacturers for extra taxation. [via Geek.com]

Ford MyKey adds radio censorship to further control teen driving habits

Daddy doesn’t have to take the T-Bird away, he can just take all the fun out of driving it. That is, if the T-Bird is actually a Taurus. Ford’s MyKey system has been engendering teen resentment since the release of the 2010 Focus, allowing parents to limit max speeds and cap radio volume, but parental control doesn’t stop there — the 2011 MyKey can selectively block radio stations. Starting next year, parents will have the option to block 16 Sirius radio channels from the car’s dial, among them Howard Stern, Playboy, and Hip-Hop Nation. Optional radio censorship isn’t the only new feature for MyKey, which allows owners to program a key to fit their specific level of paranoia — the new version allows parents to set top speeds between 65 and 80mph, instead of the previous fixed cap of 80mph. Other controls carrying over from the original system include a chime that sounds at 10mph intervals, starting at 45mph, and an advanced notice when fuel levels are low. The new features will come standard issue on the 2011 Ford Taurus and Ford Explorer, and will eventually reach across both the Ford and Lincoln brands.

Thanks In Part To The Northeast Blizzard, Online Holiday Spending Surges To Record $30.8 Billion

Online holiday spending continues to set records. comScore is reporting that retail e-commerce spending in the U.S. for the first 56 days of the November to December 2010 holiday season has reached a record $30.81 billion, which is an 13 percent increase versus the same period last year. The past week before Christmas saw $2.45 billion in spending, an increase of 17 percent versus the corresponding week last year. As expected, comScore reports that the massive snow storm that hit the Northeast region of the U.S. over the weekend helped push post-Christmas spending to record levels. The company also reports that in terms of specific products, Computer Hardware ranked as the top growing category for the holiday season with a 23 percent increase versus last year. Interestingly, handheld devices (such as iPads and e-readers) and laptop computers have driven much of the growth in this sector.

Haven’t had enough CES titillation yet? Good. ASUS has apparently been up to some mischief overnight in uploading and then pulling a new version of its teaser video from a week ago, though this time it also included explicit product names attached to some quite informative diagrams. It looks to be the full family of upcoming CES tablets, with the EP121 touting stylus input and a wireless keyboard, the EP102 showing that there will indeed be a slider in ASUS’ Pad family, and the EP101 looking like, well, a laptop. There’s also a media-centric EP71, whose proportions make it seem likely to be a sort of oversized PMP. Why did Pluto lose its planet status? Because it never mattered enough

It’s kind of hard to accept, Pluto has always been our favorite underdog, but the truth is that the Solar System‘s ninth planet was never really significant enough to earn that designation. Such is the coldly logical reason given for its removal from the planetary annals by a man who had a lot to do with its demise. Caltech astronomer Mike Brown discovered Eris, what he’d hoped was the tenth planet, back in 2005, but its extreme distance from the Sun and diminutive (by planetary standards) dimensions disqualified it from consideration. Unfortunately, its discovery is what doomed Pluto to be downgraded to a “dwarf planet,” though Mike’s not shedding too many tears over it. In fact, he’s gone and written a book about the whole thing, the smug planet destroyer that he is. You don’t have to buy it to learn more, however, as the source link has an interview with Mike all ready and waiting.

Wifi Browser Login makes ‘browser login’ hotel wireless connections easier on Android

Getting hooked up to your hotel’s ‘browser login’ wireless signal is easy enough if you’re on a laptop, but connecting with a smartphone when you want to save mobile data dollars can be a bit trickier. For Android users, a free app called Wifi Browser Login (WBL) makes the process a little bit smoother.

Once installed, just jump into the WBL settings and set your preferred options. To connect, simply keep your eyes peeled for a notification to appear when the app detects browser-based access protection. The app can also be configured to automatically open your default Web browser so that you can establish a connection immediately.

As Lifehacker points out, this would make a brilliant addition to a future version of the Android OS itself, but in the meantime the app is free, easy on resources, and well worth an install for Android users who frequent places with browser-secured Wi-Fi.

Toshiba NB550D netbook spills specs, including 1GHz AMD Ontario APU and Harman Kardon sound

Looks like the AMD Fusion netbook strategy may be to supplant Intel’s Atom wholesale in the leadup to CES, as Toshiba has just become the second manufacturer to swap out an Atom chip for a 1GHz AMD C-50 Ontario APU while leaving the rest of the design practically untouched. Notebook Italia just spotted this 10-inch Toshiba NB550D having a grand old time on the company’s German website, leisurely flexing its Harman Kardon speakers and newfound HDMI port, all the while dreaming about ways to upgrade its scant 1GB of DDR3 memory and 250GB of magnetic storage. Interestingly, Toshiba’s actually forecasting only 9.5 hours of battery life for the AMD version (compared to 10 hours with Intel’s 1.5GHz Atom N550 CPU), but we suppose that’s the price you pay to have Radeon HD 6250M graphics on board. We’ll try to get pricing and availability when we inevitably spot it at CES next week.

The rules for Hanger are quite simple: You’ve got to reach the end of each level merely by swinging back and forth and grappling with your rope. You use LEFT and RIGHT to swing back and forth; once you gather enough momentum, hit SPACE to let go and fling yourself on; then hit SPACE again to latch onto the ceiling once more.

Careful, though: If you swing too high and hit the ceiling, you start losing body parts. The legs go first, then the arms, and then a few other random tidbits. That’s where the gore comes in – when you lose a body part, you start bleeding. But it’s not that bad really: You can keep on playing right until you lose all body parts, and there’s no time pressure.

It takes a few minutes to master the physics of the game, but it’s really quite fun once you get the hang of it (see what I did there?).

Google Targets Small Businesses With $100 Million Worth Of AdWords Credits

Google is going after local businesses in a big way. It is promoting Google Places any time someone does a local search, it tried to buy Groupon for $6 billion, and it put star exec Marissa Mayer in charge of local products. Since the middle of December, it’s been running a $100 million marketing promotion aimed at small and medium-sized businesses to try to get them to sign up for AdWords. Small businesses that sign up by December 31 have until mid-February to spend $100 on AdWords, after which they will be given another $100 credit. The promotion is good for “the first one million businesses only.” If one million businesses sign up and spend that $100 the total value of the campaign will be $100 million. Of course, the campaign won’t really cost Google anything. It is spending $100 to acquire these small local business as new customers. It has offered similar promotions in the past. But Google’s efforts go beyond offering these credits.

Semantics, Bar Bets and the Battle for Wine History

For my bachelor party in 2005, my friends and I descended on New Orleans, pre-Katrina, for a long weekend of debauchery.  Just as we arrived, a street grifter, part of the New Orleans patina, said to my brother, “I’ll bet you five dollars I can tell you where you got your shoes.”  My brother, hardly a sucker, but possessing enough legacy small town character to be cowed, took the bet thinking, “There’s no way this dude is going to know where I ‘got’ my shoes.”

When the grifter smiled 1000-watts of teeth and said, “You got your shoos ON Bourbon St. in Nawlins, Loueesianna,” my brother looked down at his feet now being swallowed in a sea of asphalt on Bourbon St. and reached for his pocket to pull an Abe Lincoln, smiling at the creative semantics that exposed him as tourist, despite the lack of camera.
 
The issue of semantics is an interesting one in the art of the con and elsewhere because American wine history is full of semantics, in addition to being good fodder for a wine bar bet.

Formed at the confluence of the Allegheny and Monongahela rivers in Pittsburgh, Pennsylvania and curling southwesterly to Cairo, Illinois where its mouth meets the Mississippi, the Ohio River traverses the perimeters of Ohio, Kentucky and Indiana where an eddy-like northwestern flare adjoins the three states and an area known as the, “Golden Triangle,” an area commonly believed to be the birthplace of American wine, and still a battleground for wine history.

As a fan of wine history, I’ve read numerous accounts of the attempts at viticulture in the United States.  American Vintage, Indiana Wine, and A History of Wine in America all cover similar ground with different protagonists.

As well, longtime readers of this site may recall posts from early 2006 in which I excerpted passages from The American Vine-Dresser’s Guide authored by John James Dufour and published in 1826, the first such American book written about matters of the vine.  While re-publishing the book passages failed to hold my (and readers) attention, it did reinforce a 200-year recounting of some of the very earliest attempts at successful viticulture in the U.S.

Aside from underscoring that American wine history is anything but conclusive, these historical accounts glance at the French Huguenots in Florida working with native grapes in the early to mid-1500s while likewise speedily moving past Spanish missionary efforts in Baja California up the California coast.  However, what isn’t given short shrift in the annuals of history is the ideological effort to promote U.S. viticulture and wine in the U.S. led by Thomas Jefferson, from Virgina, in the late 1700s and early 1800s.  It was Jefferson’s paternal leadership that, ultimately, birthed a wine movement that continued to move west throughout the 1800s before meeting the temperance movement and Prohibition in California.

Aside from Jefferson, what these historical accounts all share is placement of “The Golden Triangle” as the epicenter for wine in the early 1800s.

This revisiting of history became top of mind recently as I did some behind the scenes research for an advertising agency and their client, Kentucky Wine, the grower and consumer marketing organization for the state of Kentucky.

As I read the history on the Kentucky Wine web site, they exclaimed, “America’s commercial wine industry was born in Kentucky in 1798” led by (non-Anglicized) Jean-Jacque Dufour.

“Wait a second,” I thought …

Indiana claims Vevay, IN, on the banks of the Ohio river, and (the Anglicized) John James Dufour as the basis for, “The first successful wine production in the United States,” a sentiment shared by Dufour himself in The American Vine-Dressers Guide.

Hmm …

Undaunted, by the conflicting accounts, I checked the Ohio Wine site and then cross-referenced against a dog-eared and highlighted copy of American Vintage for corroboration.

Both the Ohio Wine Association and American Vintage cite Nicholas Longworth as successful wine’s forefather with American Vintage noting, “(Longworth) owned the first commercially successful winery in the United States.  (He) went on to become American wine’s founding father …”

Untangling this mess, unfortunately, requires an astute eye.

Kentucky had the first *attempted* commercial winery called the Kentucky Vineyard Society based on vitis vinifera cuttings from South Africa and the Cape grape, an effort that ultimately failed. 

Indiana had the first successful *vineyard operation* based on Dufour transporting more Cape cuttings from across the river in Kentucky and being able to sell wine for the first time, before failing again.

Meanwhile, some 20 years later, in the 1820s, Longworth chucked the pursuit of the Cape grape and started a successful *winery* that led wine production in the U.S. for thirty years based on a native grape called Catawba, leading the Cincinnati area to be nicknamed, “America’s Rhineland”—a nickname that lives on in the “Over the Rhine” neighborhood.

How does this convoluted wine history help you win a wine bar bet?  Good question … it is complicated.

The key to duping a friend after a couple of glasses of wine and a numbing and lengthy discourse on the Golden Triangle, John James Dufour and Nicholas Longworth, is to lull them into a sense of security while they’re dizzy with trying to figure out who founded what and where …

… Simply say to them, “I’ll bet you five bucks you don’t know who is on the $2 bill.”

Anybody who guesses Thomas Jefferson deserves to win, though most won’t, and as I learned early in life, “If you can’t dazzle ‘em with brilliance, baffle ‘em with bullshit” which seems apropos to grifters in New Orleans and the accuracy of most of wine history anyway …

This method involves actually altering the internal components of the phone, particularly the GPS antenna and it contacts. You will also need to be running the JI6 modem or later, and your phone will have needed to be manufactured prior to October.  Let us be very clear that this method involves breaking the Vibrant down completely.

Oh LG, you infernal tease. Instead of politely revealing its full set of plans for CES 2011, the Korean company keeps gently peeling away the layers of ignorance, with today marking its pre-announcement of a new Cinema 3D TV set. The LW6500 opts for passive 3D glasses, in place of the currently popular active shutter goggles, which has garnered it a couple of industry certifications to say that its 3D is guaranteed, definitely, totally flicker-free. Aside from that, you get a neat brightness booster to ensure that switching on the third dimension doesn’t dim the picture unduly, while the rest of the specs and extras on this 200Hz panel seem mostly unremarkable. We’ll be casting our eyeballs over it at CES next week, which will be followed, we’re told, by a rollout in select markets shortly thereafter.

Facebook, in a continuing drive to upgrade the most popular portion of its site, will roll out facial recognition auto-tagging of photos in the next few weeks — if you live in the US, anyway.

Now, when you upload photos, Facebook will compare the faces in the photos with the faces of your friends. If a match is found, you’ll be prompted with a suggested tag. If Facebook can’t identify a person, it will ask you to enter their name, which will presumably help with identification in the future. If you upload a batch of photos of the same person — say, from a wedding or birthday party — Facebook will group those photos together and suggest a tag, making tagging a one- or two-click affair.

With a shocking grasp of foresight, Facebook is going to let you opt out of the auto-tagging process, too! If you don’t want your face to be recognized in other people’s uploads, hop over to Privacy Settings > Customize Settings, and deselect “Suggest photos of me to friends.” [This option doesn't seem to be visible yet, but that could be because I'm in the UK -- or because the roll-out hasn't begun.]

There’s no mention of whether you’ll be able to auto-tag old photo albums, but I suspect it will be possible.

Motorola Cliq 2 pictures hit the outside world?

What, you didn’t forget about the Cliq series, did you? The followup to Motorola and T-Mobile’s slider’s been long rumored — we heard a few morsels of information back in September — and now CellPhoneSignal has a few pics of what it claims is the Begonia, aka Cliq 2 (for T-Mobile, naturally). The keyboard here is, well, interesting, to say the least, and there’s also apparently a five megapixel camera on the back. We’re not really sure how our thumbs feel about the layout, but if this is legit, we’d reckon they’ll get to try it out themselves sooner or later. Olympus E-PL2 camera leaked, Penpal Bluetooth dongle to share photos via smartphone

CES 2011 is just around the bend, and while LG’s 72-inch monstrosity will undoubtedly see its fair share of attention, Olympus is hoping to shake things up in the camera realm. Or so we’re led to believe. The shot above is purportedly the first leaked image of the outfit’s forthcoming E-PL2, the Micro Four Thirds followup to the E-PL1. The real question here is this: did Olympus’ engineers take your advice on how to change it? According to 43 Rumors, this guy will ship with a new 14-42mm f/3.5 – 5.6 kit lens, a ‘direct movie’ button, high-res 3-inch display, an ISO ceiling of 6400 and an intriguing Bluetooth module as an option. Cleverly dubbed Penpal, this is essentially the most sensible method of sending photos you snap on your camera to the web, be it on Facebook, Flickr or any other social network. If you’ve got the apparatus plugged into the hot shoe, you can sync it with your BT-enabled smartphone (Android or “Windows Mobile,” we’re told) and use its cellular connection to complete the upload. Definitely a more logical approach than shoving a 3G chip into a digicam, and undoubtedly a trend we expect to see take off in 2011. Regrettably, there’s no pricing or release information to share, but all should be revealed in a matter of days.

Gawker Media hacked, 1.5 million usernames stolen, CMS breached

Gawker Media, the company behind Lifehacker, Gizmodo, and several other major blogs, has been hacked. This has been an ongoing story for a couple of days now. At first it seemed only the user database had been compromised, but as further details emerged, it became evident Gawker’s content management system had also been breached. A group going by the name ‘Gnosis’ appears to be taking credit for the hack, which itself appears to be in retaliation to references made by Gawker Media relating to 4chan and other groups. Screenshots mocking 4chan from Gawker’s internal Campfire group chat have been exposed to the public.

Around 270,000 user accounts and passwords have been released so far. So, if you happen to have a user account on Gizmodo, Lifehacker or any other Gawker website, now would be a very good time to change your password.

Rabbids Travel in Time is an explosive Time Waster

So… you’re a rabbit, and you seem to have some anger management issues. And you have a fairly large supply of explosive toilet paper. Oh, and you really don’t like neanderthals.

Tracking so far? If so, you’re going to enjoy Rabbids Travel in Time. What you see in the screenshot is an adorable rabbit taking aim at the last remaining caveman for this particular level (it started off with three). Once you aim, you need to decide how hard you’re going to pelt the caveman with your roll of explosive toilet paper. You do this by moving the mouse cursor along the arrow (as you can see, it’s about at the two-thirds mark for this screenshot).

Once you aim and decide on the velocity, physics takes over. The toilet paper will bounce away, or come to rest somewhere, and then explode. I didn’t see a way to make the fuse any shorter or longer – the explosion always seems to come at the same interval, which is about two seconds after you throw the roll.

Sometimes there’s more than one rabbit (or “rabbid”) per level, as you can see in the screenshot. This is nice because they can play “catch” – i.e, you throw the toilet paper from one rabbit to the next, and the other rabbit takes aim and reaches the eventual goal. Fun!

Robot Safety Center opens up in Japan, Crash Test Dummies still an unfortunate name for a band (video)

The fair city of Tsukuba, which (as you know) is located in Ibaraki Prefecture, Japan, has recently become home to the new Robot Safety Center. A collaboration between a number of organizations including Japan’s Automobile Research Institute (JARI), the center has areas for testing various robots and exoskeletons for things like obstacle detection, electronic jamming resistance, durability, and more. As well as developing safety standards for the devices, it is hoped that within the next five years it will provide certification services for new robots as they become commercially available. Some eighteen tests have been installed at the facility thus far, and we must say that it looks like fun! See some examples after the break.

Kodak Pulse email-to-photo-frame system down for days, millions of memories trapped in the cloud (updated)

We definitely know quite a few people (including this very editor!) who bought their parents Kodak Pulse WiFi photo frames over the holidays, since they seem like a perfect way to share pictures without any fuss — you can just email the frame directly. Unfortunately, it seems like this cloud service has a dark, dark lining: Kodak’s backend email servers have been down since at least Christmas Eve, rendering the Pulse’s most interesting feature essentially useless. What’s worse, that status display above is more or less buried on the Pulse web site, so it’s not even immediately clear that the problem is on Kodak’s side — and when things turn back on we’re guessing more than one Pulse owner will find tons of duped photos on their frames from multiple email attempts, since the system doesn’t confirm email receipt. We’ve heard a few anecdotal stories about email photo delivery slowing down / stopping during previous high traffic periods, so you’d think Kodak would have sorted this out by now, but we guess not — we’ll let you know when the company tells us about a fix.

Update: Kodak emailed us to say things are working again — here’s the statement:

We experienced slower performance of the Pulse server over the holiday weekend due to much higher than anticipated volumes. This resulted in a delay of pictures that were emailed to the Pulse frame. We did immediately address this issue and any pictures consumers emailed have since been delivered. We apologize for the inconvenience this caused our customers. It is our goal to ensure a great experience for all Pulse owners.

MSI Wind U270 netbook emerges with 1.6GHz AMD Zacate processor

We weren’t actually expecting to see any Zacate-based machines until CES 2011 kicked off in earnest, but it looks as if MSI is hoping to snag a little wind from the sails of its competitors. In a small Taipei-based event, the outfit quietly snuck out a machine that we can only assume will become official in the coming days — the Wind U270 netbook is an 11.6-incher with a 1.6GHz Zacate processor, 4GB of RAM, a 320GB hard drive and no optical drive to speak of. Other specs include a VGA output, two USB 2.0 ports, a single USB 3.0 socket, a Kensington lock port, 4-in-1 card reader, Ethernet jack and an overly glossy 1366 x 768 resolution panel. Courtesy of Netbook News’ hands-on, we’ve spotted a traditional chiclet keyboard, a split mouse button (huzzah!) and a trackpad that may very well not exist if it were any smaller. MSI wasn’t about to spill any details on a ship date or price, but feel free to get yourself acquainted with the aesthetic in the video just past the break.

Official Kinect drivers now available for Windows and Ubuntu

If the recent demonstrations of the Kinect’s potential have you all hot and bothered, brace yourself: official drivers are now available for both Windows and Ubuntu. It’s all thanks to the OpenNI (Natural Interaction) initiative, where PrimeSense — the company behind the Kinect — happens to be one of the founding members.

OpenNI aims “to accelerate the introduction of Natural Interaction applications into the marketplace,” and releasing drivers is a good first step. Binaries for 32-bit Windows and both 32 and 64-bit Ubuntu systems are available for download and source code is also available. There’s also a full OpenNI user guide in PDF format.

Here’s hoping driver availability leads something more than slick demos — we’d love to actually be able to control our desktops this way.

Automattic has officially brought WordPress to Windows Phone 7 for blogging on the go. The WordPress app stays faithful to the general Windows Phone 7 aesthetic of huge typography that goes beyond the current view, and horizontally scrolling screens. But the app isn’t really meant for writing epic posts (although you can compose new posts). Like its Android and iOS counterparts, it lets you format text, set categories and tags, and even add pictures to a post. You can then publish your post on the spot, or save it for editing later when you’re sitting at an actual computer.

More useful, perhaps, is the WordPress app’s ability to moderate comments on-the-go. The app lets you bulk-edit comments, so you can de-spam your blog in one fell swoop from the road.

Last but not least, if your blog is hosted on WordPress.com, the new app lets you monitor a host of stats such as Views, Post Views, Clicks and more. Winner Announced in Menu Wine Breather Giveaway

It looked a little bleak there early in the week after announcing a giveaway for a Menu Wine Breather.  We didn’t get a single entry until yesterday and then we wound up with 10.  Maybe there was a little gamesmanship going on with people trying to keep it quiet and sneak in at the last minute with an entry.

As promised at 7:00 am Eastern I counted up the entries we had.  I numbered the comments we received sequentially: 1 for the first comment, 10 for the last one.  Then I used random.org to generate a number between 1 and 10.  The winning number was 8:

An interesting observation in the comments was that the device could have a promising future in winery tasting rooms where they’re looking to quickly double decant wine so they can pour it from their own bottles for label/brand recognition.  I think that’s a pretty smart idea.  I wonder if we’ll be seeing more Menu Wine Breather’s in action at winery tasting rooms in the coming year?

Arm Holdings will unveil new plans for processing cores that support 64-bit computing within the next few weeks, and has already shown samples at private viewings, sources close to the company said at an Arm technology conference in Taipei.

The company’s move into 64-bit computing shows it’s serious about putting out powerful processors to meet the needs of businesses and consumers. Facebook, in a continuing drive to upgrade the most popular portion of its site, will roll out facial recognition auto-tagging of photos in the next few weeks — if you live in the US, anyway.

Now, when you upload photos, Facebook will compare the faces in the photos with the faces of your friends. If a match is found, you’ll be prompted with a suggested tag. If Facebook can’t identify a person, it will ask you to enter their name, which will presumably help with identification in the future. If you upload a batch of photos of the same person — say, from a wedding or birthday party — Facebook will group those photos together and suggest a tag, making tagging a one- or two-click affair.

With a shocking grasp of foresight, Facebook is going to let you opt out of the auto-tagging process, too! If you don’t want your face to be recognized in other people’s uploads, hop over to Privacy Settings > Customize Settings, and deselect “Suggest photos of me to friends.” [This option doesn't seem to be visible yet, but that could be because I'm in the UK -- or because the roll-out hasn't begun.]

There’s no mention of whether you’ll be able to auto-tag old photo albums, but I suspect it will be possible.

Samsung said to be bringing a 4-inch Galaxy Player to CES 2011

Samsung Hub is reporting this morning that Samsung intends to introduce a new Galaxy Player to the tech gathering known as CES early next month. We’ve not been able to track down Samsung’s official word on the matter, but the Hub‘s information details a 4-inch Super Clear LCD display with 800 x 480 resolution, Android 2.2 as the operating system (replete with Sammy’s own TouchWiz layer, by the look of that screenshot above), a 1GHz CPU, 3.2 megapixel imager on the back plus a front-facing camera, and a 1200mAh battery. Android Market access is also in the cards, apparently, but when (or if?) this most worthy successor to the Galaxy Player 50 will make its US retail debut remains a mystery for now. We’ll be sure to ask when we get our hands on the new hardware next week.

Google’s next Android Music app leaks out, gives hints of a 3.0 UI overhaul

Remember at Google I/O this year when Google showed off “something beyond Froyo” in the music realm? The demo included an all-new music player (boy, wouldn’t that be nice!), along with magical features that let you push web-purchased songs to your device, and allowed you to browse your PC’s music library from your phone as if it was on the device itself. Well, none of that showed up in Gingerbread, unfortunately, but the new music player itself has just leaked out. It’s super buggy, and of course doesn’t have any of those fancy wireless features we’re waiting on, but it could offer a bit of a glimpse into 3.0, at least as far as UI tweaks go.

The differences seem minimal but aesthetically pleasing, with blurred background images behind frosted glass widgets as far as the eye can see. One important thing to note is that there is a menu button on the top right, at least in some views, and we went back and watched Andy Rubin’s tablet time at D: there’s clearly the same menu button on each app. [Suspenseful strings begin to play]. It seems Google might be getting rid of its hardware buttons entirely, or at least making menu functionality a more obvious part of its relevant applications, instead of the “surprise!” button it currently represents. There are also points in the video where tapping the application’s icon in the top left takes you to the “home” of the app, and we also found similar icons on the top left of each application Andy demoed at D — and we’re guessing they have the same functionality. Kindle 3 Beats Harry Potter Book As Bestselling Product In Amazon?s History

This isn’t a big surprise. Amazon has just released a statement reporting that the new, third-generation Kindle has now surpassed ?Harry Potter and the Deathly Hallows? as the best-selling product in Amazon?s history. Of course, Amazon doesn’t reveal the total number of Kindles sold (Bloomberg recently reported that 8 million Kindles will be sold this year compared to 2.4 million units sold in 2009). On Christmas Day, Amazon says that more people turned on new Kindles for the first time, downloaded more Kindle Buy Once, Read Everywhere apps, and purchased more Kindle books than on any other day in history. And Amazon’s worldwide fulfillment network shipped over 9 million units across all product categories.

8pen is a painful way to enter text on Android devices

8penText entry on a small screen is a formidable problem; as can be expected, there are a ton of competing solutions, with Swype (and Swype-like keyboards, such as SlideIT) getting a lot of attention.

8pen takes a completely different tack to the keyboard problem, by eliminating it altogether. To paraphrase Bob Marley, “no keyboard, no cry.” According to 8pen, by drawing “natural” gestures on your touchscreen, you’d be able to “write without viewing”.

The idea is to give you a central graffiti-like area with a grid of characters. All gestures originate from the central area and terminate there, too. To type the letter “e”, for example, you have to start at the center, swipe down, hang a left (crossing the green line) and go back to the center area. To type “l” (a lowercase L), you have to do the same, but continue one quadrant further, returning to the center dot from the top quadrant, having crossed both the green and blue lines.

If this sounds insanely complex, you’re right. I’m no stranger to alternative keyboard layouts, and I know full well that switching input methods takes some getting used to. But compared to SlideIT, 8pen is downright painful. And yes, I will review SlideIT soon.

Apple Remote app updated for AirPlay video streaming

Version 2.0 of the app already brought support for the new Apple TV and the iPad, but Apple’s has now just released another more minor update to its Remote app for iOS devices that adds another much-anticipated feature: support for AirPlay video streaming. What’s more, the app now also boasts the ability to access internet radio stations from iTunes on your computer, as well as the ability to control movies and TV shows on your computer that are rented from iTunes — not to mention the usual stability and performance improvements. Google Groups receives an almighty restyle and rebirth

Google Groups restyle

With nary a muffled fanfare and eclipsed by Google’s other massive releases over the past two days, Google Groups has been significantly revamped. In true, modern-day Google style, it now looks almost… pretty. It’s only the first step of an overhaul, too — there’s more to come, including improved spam control, moderation and search features.

Google has focused on the discussions aspect of Groups first — so while finding new groups and creating new topics has a shiny new UI, you will have to return to the old interface to perform administrative tasks. Check the New Groups vs. Old Groups page for more info.

As TechCrunch’s Siegler mentions, the new style feels more than a little like Wave. With Wave’s retirement, the redistribution of its team members, and Google’s re-use of JavaScript libraries (and thus UI elements), it’s safe to assume that some of Wave might have ended up in Groups. Still, who cares — Groups looks so much better now.

Samsung said to be bringing a 4-inch Galaxy Player to CES 2011

Samsung Hub is reporting this morning that Samsung intends to introduce a new Galaxy Player to the tech gathering known as CES early next month. We’ve not been able to track down Samsung’s official word on the matter, but the Hub‘s information details a 4-inch Super Clear LCD display with 800 x 480 resolution, Android 2.2 as the operating system (replete with Sammy’s own TouchWiz layer, by the look of that screenshot above), a 1GHz CPU, 3.2 megapixel imager on the back plus a front-facing camera, and a 1200mAh battery. Android Market access is also in the cards, apparently, but when (or if?) this most worthy successor to the Galaxy Player 50 will make its US retail debut remains a mystery for now. We’ll be sure to ask when we get our hands on the new hardware next week.

There’s no need to tell you that a lot was (and still is, in a way) riding on Nokia’s N8. It was said to be the outfit’s first dead-serious smartphone to rival the giants of today, and it was also Nokia’s first chance to truly reveal Symbian^3 to the world. We’ve already churned out our two pennies on the matter, but for those of you who bought in, now’s the time to get really real. Are you satisfied with where Nokia’s going with the N8? Do you seriously see a long and lively future when looking at Symbian^3? If someone (read: UPS) accidentally delivered the keys to the Finnish kingdom to you, how would you go about tweaking and / or reshaping the N8? Would you have selected a different operating system? Watson, an artificial intelligence powered by IBM’s latest, disgustingly-powerful POWER7 processors and the DeepQA natural language parser, will play Jeopardy against flesh-and-blood humans in February, for a $1,000,000 grand prize.

Accurate, computerized natural language processing is a killer technology, and perhaps the last cornerstone in the creation of a Skynet-like entity. Search engines such as Google have made great strides, but their emphasis has always been on finding the right results, rather than understanding your query perfectly. DeepQA’s sole purpose is to create a system that understands spoken natural language perfectly; from your literal, spoken or written words, down to the exact meaning of those words. To do this, it needs to understand sarcasm, irony, and a world of other linguistic constructs and inflections. Check the IBM FAQ for tons more information about Watson and DeepQA.

Needless to say, once a computer understands the meaning of our utterances, a wealth of possibilities are opened up. We will finally see Star Trekesque computers! Computer, plot a course to the office. We will be able to dim the lights, or turn the music up, just by talking.

The human vs. computer Jeopardy showdown will air in 2011, February 14-16, with the two all-time most successful contestants being pitted against IBM Watson to win $1,000,000. Watson has already beat former Jeopardy winners in internal testing, so it could be a very close battle indeed. Also worth noting is that PBS will air a documentary about the creation of Watson on February 9, just a few days before the game show.

I for one welcome our new computer overlords…

Skyfire 3.0.1 for Android brings SD storage and background download notification

Skyfire, an alternative browser for Android, has just been updated to version 3.0.1. This is a minor point update, so they haven’t even bothered updating the splash screen – it still shows as 3.0 when I load it on my device.

Still, the update is noteworthy, if only for the fact that it supports Froyo’s ability to store apps on the SD card, so you don’t have to sacrifice any of your device’s precious onboard storage space for Skyfire. Froyo users will also enjoy being able to upload files from the browser.

Even if you’re not running Froyo, though, it’s a worthy update: Crash reporting has been improved, as well as the browser’s background download capabilities. There’s a barcode waiting for you after the jump.

Sanyo Eneloop Pedal Juice battery pack preview

It’s Christmas Day, which probably means that at least one toy that you received (or gave) won’t be fully functional until Monday. Why? Batteries. It’s an age-old problem, that “batteries not included” thing, and it’s one of the reasons we’ve fell so in love with Sanyo’s Eneloop line. Without question, the Eneloop rechargeable AA batteries are amongst the best and most reliable that money can buy, so whenever another Eneloop product pops out, it obviously catches our eye. Sanyo’s branching out pretty severely with its latest device, and being that at least 3.5 members of the Engadget staff have strummed a six-string once or twice, we had to take a closer look at the Pedal Juice when given the chance. For those that missed last month’s introduction, this pedal-sized block of energy is designed to provide 9V power to six or seven effects pedals, miniature amplifiers or electric drum pads (amongst other musical doodads). So, does this thing live up the the Eneloop reputation? Find out after the break.

Vee?s Law of Compunction

With new wine sales channels (like wine clubs) proliferating like mushrooms after a spring rain, I’m contemplating creating a new law of popular thought—like Murphy’s Law—except my law is about the forever altered line that once separated wine editorial from wine commerce.

I call it Vee’s Law of Compunction.  The name of the law itself is a misnomer, and maybe that’s the point – compunction indicates a distress of conscience, and I don’t think that exists, even if it should.

208 weeks ago or 48 months ago it would have been unfathomable and heretical for an organization that notably reviews wines to also sell wine.  Hidebound tradition dictated that those that review wine should not be a party to the commerce of wine.  This extended to magazine mastheads as well, yes.

Then, Gary Vee, owner of a wine store in New Jersey, started doing reviews.  Sure, he took some flak based on the suggested impropriety of reviewing what you’re selling (he was also greatly abetted by the notion of, “new territory, new rules”), and he artfully deflected that criticism with statements indicating that he reviews fairly and often dismisses wines that he sells.  Of course, his is an accurate statement even if a violation of the wine world’s unspoken rules of propriety and clearly a gray area when contrasted against his ethos of, “Trust YOUR palate.”

With that watershed moment, proverbially speaking, the horse left the barn, the ship sailed and the genie left the bottle …  A precedent had been set and the blurred lines of what wine content is and where it comes from organically disappeared along with these unspoken rules of fair, ethical play.

Since then, traditionally ethical media properties like the Wall Street Journal, Food & Wine magazine and other beacons of wine editorial have started their own wine clubs (along with a slew of others) and have filled the breach of branded (and implicitly recommended) wine club sales with consumer’s to near overabundance. 

To fully understand the implications of new areas to sell wine is to understand the notion of sales “channels.” 

When I interviewed for my first job out of school I needed the HR recruiter to explain to me what “channel” meant as she referred to the channel sales job for which I was interviewing. My business naiveté faux pas aside, I now well know that a “channel” is one specific sales focus area for an organization. 

Wineries have the three-tier distribution channel (and within that channel you have on and off-premise placement), the tasting room channel, the direct-to-consumer channel and, now, exceedingly, the gray market channel with intermediaries that are little more than short term pimps for a tarted up darling.

Despite the inherent nature of the gray market, all wineries (all businesses!) are looking for alternate sales channels.  Where can a winery sell its wine where, perhaps, they haven’t sold it in the past? 

This background brings us to the latest entrant in the “I recommend wine and, by the way, I can sell it to you to” school of New Thought—The Winery Club by Wine Enthusiast.

Lost in the din of the holidays, The Winery Club by Wine Enthusiast is likely going to miss the au courant naysayers in the online court of public opinion.  However, I can’t help but feel reticence, perhaps even my own compunction, about its launch despite being a bystander.

I should note, I like Wine Enthusiast magazine, I’m a long-time subscriber to the magazine, a confirmed recycler of the catalog, and I send emails to the publisher and I get replies. In addition, I am an admirer of their principal wine critic, Steve Heimoff; an affection that has grown over the last several years.  Yet, I’m not an apologist, either …

Neither a Huck Finn whitewash nor a Gary Vee traipse across boundary lines of traditional demarcation do not create validation for a business decision.  A mandate from the Gods of Capitalism doesn’t become so just because the rules of engagement have changed. 

In short, I’m sorely disappointed that Wine Enthusiast has chosen to create a wine club, indelibly erasing the lines for ethical behavior that separated those that opined on wine from those that sold wine.

Now, Wine Enthusiast Companies will rightfully and fully say the wine club is separate from the magazine; more aligned with the wine accessory catalog business than the magazine.  Yet, to me, it still feels like a shift in the force, to use a Star Wars reference – instead of the recognition of an area of profitable commerce, it smacks of the loss of the last vestige of integrity.

Destroyed in the process of what’s right has been a decision for right now.

Now, make no mistake the majority of the soon-to-be members of their “The Winery Club” have no idea that a wine magazine selling wine crosses the border into the dubious, nor do they care.  Yet, that’s exactly the point.  Perhaps, Vee’s Law of Compunction isn’t required because that indicates the opportunity for regret, but simple common sense is required …

For me, the wine world is a respite from the r
